Terms and Conditions

Business Support and Trade Services Directory Listings

These Terms and Conditions (“Terms”) govern access to and participation in the TradieWives Directory (the “Directory”, the “Service”), operated by TradieWives, ABN 13 570 404 594 (“TradieWives”, “we”, “us”, “our”).

By purchasing, enrolling in, or accessing a Directory listing, the business or individual enrolling (“you”, the “Listing Business”) agrees to be bound by these Terms. If you do not agree, you must not purchase or maintain a Directory listing.

These Directory Terms apply specifically to paid Directory listings. They sit alongside, and do not replace, the general TradieWives Website Terms of Use, which continue to apply to your use of the TradieWives website and affiliated social media pages generally.

1. Definitions

• “Account” means the account created by the Listing Business on the Site to manage its Directory listing.
• “Business Support Services” means the Directory category for businesses that provide services to trades businesses or their owners (such as accounting, marketing, HR, legal, coaching or similar business support services), comprising the Get Listed, Get Active and Amplified tiers.
• “Commencement Date” means the date the Directory listing begins, being the date on which the Fee is first paid.
• “Directory” or “Service” means the TradieWives business directory service, through which Listing Businesses may be listed and promoted to the TradieWives community.
• “Fee” means the price for the selected tier and Term, as set out on the Site or checkout page at the time of purchase.
• “Listing” means the business profile, content and information published by TradieWives on behalf of the Listing Business as part of the Service.
• “Site” means the TradieWives website, member portal, and any associated platforms through which the Service is delivered.
• “Term” means the billing cycle selected by the Listing Business Monthly or Yearly Commitment as set out in clause 4.
• “Tier” means the specific Directory package purchased, being one of: Get Listed, Get Active, Amplified (Business Support services), or The Trusted Tradie, The Tradie Listing (Trade Services).
• “Trade Services” means the Directory category for trade businesses themselves, comprising The Trusted Tradie and The Tradie Listing tiers.

2. Agreement to Provide the Service

1. This Agreement is formed when the Listing Business accepts these Terms and completes payment of the applicable Fee when creating their Account.
2. We may update these Terms from time to time. If we make a material change, we will notify Listing Businesses by email, and the updated Terms will apply from the date specified in that notice.
3. Continued use of the Service after a change to these Terms takes effect constitutes acceptance of the updated Terms.

3. The Directory and Tiers

The Directory is offered across two streams, each comprising several tiers:

3.1 Business Support Stream

Available to businesses that provide services to trade businesses or their owners. Tiers within this stream are Get Listed, Get Active and Amplified.

3.2 Trade Services Stream

Available to trade businesses themselves. Tiers within this stream are The Trusted Tradie and The Tradie Listing.

3.3 General

1. The specific inclusions, features and placement benefits of each Tier are those listed on the Site or checkout page at the time of purchase and confirmed in the Listing Business’s welcome email.
2. We reserve the right to update, replace, modify or discontinue any aspect of a Tier, including inclusions, features, format or structure at any time, provided the overall intent and value of the Tier is maintained.
3. We reserve the right to introduce new Tiers, retire existing Tiers, or move a Listing Business between equivalent Tiers, with reasonable notice.

4. Fees, Terms and Cancellation

Listing Businesses select a Term for their chosen Tier when creating their Account. Both Monthly and Yearly Commitment Terms are available across all Tiers, as set out below:

4.1 Monthly Term

1. The Fee is billed monthly in advance from the Commencement Date and automatically renews each month.
2. A Listing Business on a Monthly Term may cancel at any time by giving TradieWives at least 30 days’ written notice. The Listing and billing will continue for the remainder of the notice period and will end at the conclusion of that 30-day period.

4.2 Yearly Commitment Term

1. The Fee is billed annually in advance from the Commencement Date.
2. The Yearly Commitment Term automatically renews for a further 12-month period at the end of each annual cycle, unless cancelled in accordance with this clause.
3. A Listing Business on a Yearly Commitment Term cannot be cancelled during the current 12-month period. Cancellation requests must be submitted by contacting TradieWives directly, and can only be actioned after the Listing has renewed for the next annual cycle. Once actioned, the cancellation will prevent any further renewal, and the Listing will continue until the end of the then-current paid annual period.

In practice, this means a Listing Business on a Yearly Commitment who wishes to cancel should contact TradieWives at any time; the cancellation will be processed and will take effect from the next renewal, rather than during the year already paid for.

4.3 Payment

1. Fees are payable in Australian Dollars (AUD) and include GST where applicable.
2. Payments are processed via TradieWives’ nominated third-party payment processor. The Listing Business is responsible for all transaction fees, bank fees, currency conversion fees and failed payment fees.
3. Where a payment fails, is reversed or is disputed, TradieWives may suspend or remove the Listing until payment is successfully processed. Continued non-payment may result in termination of the Listing without refund.
4. Pricing for a given Tier or Term may change with reasonable notice; any change will take effect from the Listing Business’s next billing cycle.
5. Except as set out in clause 5.4 (where applicable) or as required by the Australian Consumer Law, Fees are non-refundable, including for change of mind, lack of enquiries, dissatisfaction, or perceived lack of results.

5. Eligibility — Trade Services

1. The Trade Services stream (The Trusted Tradie and The Tradie Listing tiers) is intended for trade businesses that are, businesses that perform trade work directly for customers (such as building, plumbing, electrical, and similar trades). It is not intended for, and is not available to, businesses whose primary purpose is providing services to trades businesses or their owners (such as accounting, marketing, HR, legal, coaching or similar business support services). Such businesses should list under the Business Support Services instead.
2. TradieWives reviews Directory applications at the time of sign-up. However, if TradieWives becomes aware at any time, whether before, during, or after a Listing has commenced, that a Listing Business has been listed under the Trade Services but does not meet the eligibility criteria in clause 5.1, TradieWives may move the Listing Business to an equivalent Business Support tier, or suspend or terminate the Listing, at its discretion.
3. Where a Listing is terminated under clause 5.2, TradieWives will refund the unused portion of any Fees already paid for the then-current billing period, less a reasonable administration fee at TradieWives’ discretion. No refund will be made for the portion of the billing period already used, and no refund applies to prior, already-completed billing periods.
4. The Listing Business is responsible for ensuring the stream and Tier selected at sign-up accurately reflect the nature of its business, and for notifying TradieWives if its business activities change such that it no longer meets the eligibility criteria for its selected stream.

6. Trade Services Warranties

In addition to the eligibility requirements in clause 5, a Listing Business in the Trade Services (The Trusted Tradie and The Tradie Listing tiers) warrants that:

• If it is a corporation, it is registered and validly existing under the laws of the jurisdiction in which it was incorporated;
• It has full legal capacity and power to enter into these Terms;
• It holds all licences, permits, registrations, insurances and other authorisations necessary to lawfully provide the trade services it promotes through the Directory;
• To its knowledge, there are no actions, proceedings or investigations pending or threatened against it in relation to the trade services it promotes or provides to TradieWives community members; and
• It is not subject to any insolvency action, including bankruptcy, voluntary administration, liquidation or receivership.

If TradieWives becomes aware that any of these warranties is untrue, TradieWives may suspend or terminate the Listing in accordance with clause 10.

7. Listing Content

1. The Listing Business is responsible for providing accurate, current and complete information, descriptions, images, logos and contact details for its Listing (“Listing Content”), and for keeping that information up to date.
2. The Listing Business warrants that it owns or has the necessary rights and permissions to use all Listing Content it provides, and that the Listing Content does not infringe the intellectual property, privacy or other rights of any third party.
3. TradieWives may, at its discretion, edit Listing Content for formatting, length, clarity or consistency with the Site’s style, without changing its substantive meaning.
4. TradieWives reserves the right to refuse to publish, or to remove, any Listing Content that it considers false, misleading, offensive, unlawful, or otherwise inconsistent with these Terms or the TradieWives Website Terms of Use.
5. The Listing Business grants TradieWives a non-exclusive, royalty-free licence to reproduce and display Listing Content on the Site and in related TradieWives marketing materials, social media and communications, for the purpose of operating and promoting the Directory.
6. TradieWives does not verify the accuracy of Listing Content beyond what is reasonably apparent, and the Listing Business remains solely responsible for the accuracy of the information it provides.

8. No Guarantees

1. TradieWives will use reasonable efforts to promote and present Listings as part of the Directory, TradieWives makes no guarantees regarding the number of views, enquiries, leads, bookings, sales or other business outcomes that may result from a Listing.
2. Outcomes from a Directory Listing depend on many factors outside TradieWives’ control, including market conditions, the Listing Business’s own marketing, pricing, service quality, and the preferences of TradieWives community members.
3. Any examples, testimonials, case studies or placement positions referenced in connection with the Directory do not represent typical or guaranteed results.

9. Community and Conduct

By listing in the Directory, the Listing Business agrees to:

• Act respectfully and professionally toward TradieWives, its team, members of the TradieWives community, and other Listing Businesses;
• Not engage in harassment, discrimination, hate speech, spamming, or unsolicited direct marketing to TradieWives members obtained through the Directory or community platforms.
• Not misrepresent its qualifications, licensing, insurance or accreditation;
• Comply with all laws, licensing and regulatory requirements applicable to its trade or profession;
• Not use its Listing or any access gained through the Directory to disparage TradieWives, its team, or other members or Listing Businesses;
• Not share, sublicense or provide access to its Listing or Account to any other person or business, and not use the Service to create, operate or contribute to any competing directory or similar service;
• Do not use automated tools, scripts or scrapers to collect or extract data from the Directory, the Site, or other Listing Businesses’ content.

TradieWives reserves the right to suspend or remove a Listing without refund if these standards are breached.

10. Termination

1. If a Listing Business breaches these Terms, TradieWives may suspend or terminate the Listing immediately, without notice and without refund.
2. TradieWives may also terminate a Listing for any other reason by giving the Listing Business at least 5 days’ written notice. Where TradieWives terminates under this clause for a reason other than the Listing Business’s breach of these Terms, TradieWives will refund a pro-rata portion of any Fees paid that relate to the remainder of the then-current Term.
3. Termination of a Listing does not affect any rights or obligations accrued before termination, and clauses relating to confidentiality, intellectual property, liability, indemnity and governing law survive termination.

11. Third-Party Engagement and Liability

1. The Directory connects TradieWives community members with Listing Businesses for their convenience. TradieWives does not control, endorse, guarantee, or take responsibility for the quality, safety, legality, or outcome of any service or product provided by a Listing Business.
2. Any engagement between a TradieWives community member and a Listing Business is a separate agreement between those parties. TradieWives is not a party to, and accepts no liability arising from, that engagement.
3. TradieWives is not responsible for the accuracy or completeness of any information provided by a Listing Business and displayed as part of the Directory.

12. Intellectual Property

1. TradieWives owns all intellectual property rights in the Directory platform, design, branding, methodology and underlying technology, excluding Listing Content supplied by the Listing Business.
2. The Listing Business must not copy, reproduce, scrape, or use any part of the Directory, the Site, or other Listing Businesses’ content for any purpose outside the ordinary use of the Service.
3. This clause survives termination or expiry of a Listing.

13. Access and Technology

1. The Service is delivered via online platforms, which may change from time to time. The Listing Business is responsible for its own internet access, devices and technical capability.
2. TradieWives does not guarantee uninterrupted access to the Directory and is not responsible for access issues caused by technology failures, platform outages, internet disruptions or third-party service interruptions.

14. Privacy

1. TradieWives is subject to the Privacy Act 1988 (Cth) and handles personal information in accordance with its Privacy Policy, available on the Site.
2. By enrolling, the Listing Business consents to the collection, use and storage of its personal and business information as described in the Privacy Policy.

15. Limitation of Liability and Indemnity

1. Except as expressly provided in these Terms, to the maximum extent permitted by law, TradieWives excludes all other warranties, conditions and guarantees not expressly stated in these Terms.
2. To the maximum extent permitted by law, TradieWives is not liable for any indirect, incidental, special, consequential or economic loss, including loss of profit, revenue, opportunity, goodwill or anticipated savings, arising from the Listing Business’s use of the Service.
3. Where any liability cannot lawfully be excluded, TradieWives’ liability is limited, at its sole discretion, to either re-supply of the Service or the cost of having the Service re-supplied.
4. Nothing in these Terms limits any liability that cannot be excluded under the Australian Consumer Law.
5. The Listing Business agrees to indemnify and hold harmless TradieWives and its officers, contractors, employees and agents from any loss, damage, liability or cost (including legal costs) arising from the Listing Business’s breach of these Terms, its Listing Content, or its engagement with TradieWives community members.

16. General

1. These Terms, together with any checkout page terms and referenced policies (including the TradieWives Website Terms of Use and Privacy Policy), constitute the entire agreement between the Listing Business and TradieWives in respect of the Directory.
2. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
3. Nothing in these Terms creates a partnership, joint venture, employment, fiduciary or agency relationship between the Listing Business and TradieWives.
4. The Listing Business may not assign or transfer its rights under these Terms without TradieWives’ prior written consent. TradieWives may assign or transfer its rights and obligations under these Terms at any time.
5. TradieWives is not liable for any delay or failure to perform its obligations due to events beyond its reasonable control, including natural disasters, pandemics, power outages, cyber incidents, internet failures, or platform outages.
6. These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the exclusive jurisdiction of its courts.
